Dani Alves achieved a significant victory in Spanish court. While he was accused of rape and in custody, he won an old case worth millions. Now, he is free and required to regularly present himself to the relevant authorities.
The dispute received a verdict from the Administrative Court of Madrid (TEAC), which was challenged by Dani Alves. As a result, the player will receive from the Spanish tax administration an amount of 3.2 million euros.
Understanding the case
The tax fraud allegations date back to 2014, when Dani Alves was investigated for alleged irregularities in the transfer of his image rights income, resulting in less taxation.
In 2008, upon signing with Barcelona, the right-back transferred the rights to the company Cedro Sports for 1.6 million euros. At that time, the company was owned by the player himself, and his then-wife and agent, Dinorah Santana da Silva. Part of the player’s salary paid by the club was directed through the company.
Spanish authorities
The Spanish tax authorities argued that the profits made by the athlete from image rights should be considered capital gains, subject to higher taxation, according to the current tax legislation.
However, Dani Alves’ defense maintained that the declarations made to the Spanish authorities were correct, and there was no infringement related to image rights for the 2009/10 and 2010/11 seasons.
The player’s success in court came from demonstrating that his salary was in accordance with the law, being distributed 85% through the labor contract and the remaining 15% through Cedro Sports.
In February, Dani Alves was sentenced to four years in prison for rape, but he has appealed this verdict. He has paid €1 million in bail, which is why he is currently free.
